1. Agreement to Terms

By accessing or using helmetcg.com (the "Site") or submitting any application, inquiry, or form on the Site, you ("Client," "User," or "you") agree to be bound by these Terms of Service. If you do not agree, do not use the Site or submit any information.

2. Who We Are / Nature of Services

Helmet Consulting Group LLC is a financial consulting brokerage and services firm. We are not a lender, bank, or financial institution. We act as a broker and consultant connecting clients with third-party lenders and service providers. Our services include:

  • Business funding brokerage (MCA, business loans, SBA loans)
  • Credit repair consultation and dispute facilitation
  • Credit card approval guidance
  • Business staffing placement
  • Business marketing services
  • Financial advisory consulting
  • Accounting and tax preparation

By submitting an application or inquiry, you authorize HCG to share your information with appropriate third-party lenders and service providers for the purpose of fulfilling your requested service.

3. No Guarantee of Approval or Results

HCG makes no guarantee, warranty, or representation that:

  • Any funding application will be approved
  • Any specific funding amount will be offered
  • Credit scores will improve by any specific amount or within any specific timeframe
  • Any credit card application will be approved
  • Any staffing placement will result in a permanent hire

All decisions regarding funding approvals, credit card approvals, and credit score outcomes are made by independent third parties (lenders, credit bureaus, financial institutions). HCG facilitates the process but does not control outcomes.

4. Client Responsibilities

By using our services, you agree to:

  • Provide accurate, truthful, and complete information in all forms and applications
  • Not submit false, fraudulent, or misleading information
  • Notify HCG promptly if any information you provide changes
  • Comply with all applicable laws in connection with your use of our services
  • Not use our services for any illegal or fraudulent purpose

Submitting false information, including false identity information, false financial data, or fraudulent bank statements, may constitute fraud under federal and state law and may be reported to appropriate authorities.

5. Sensitive Information

By submitting a business funding application that includes your Social Security Number (SSN), Employer Identification Number (EIN), date of birth, or bank statements, you:

  • Consent to HCG collecting, processing, and transmitting that information to third-party lenders and service providers for the purpose of evaluating your application
  • Acknowledge that HCG handles this data in accordance with its Privacy Policy
  • Acknowledge that HCG does not store SSNs in any database and handles sensitive data solely for internal review and lender submission purposes

6. Fees and Payments

HCG earns compensation in the form of broker fees, ISO commissions, and service fees paid by lenders and service providers upon successful placement. For certain services (marketing, accounting, staffing), fees may be charged directly to the client. All fee arrangements for direct-charge services will be disclosed to you in writing before any charge is made.

HCG does not charge upfront fees for business funding brokerage services. You are never required to pay to submit an application.

7. Third-Party Lenders and Partners

HCG works with independent third-party lenders and service providers. HCG is not responsible for:

  • The terms, rates, or conditions of any loan, funding offer, or financial product offered by a third party
  • The performance, conduct, or decisions of any third-party lender, credit bureau, or service provider
  • Any loss or damage arising from your use of a third-party product or service

You are responsible for reviewing and understanding all terms before accepting any offer from a third party.

8. Intellectual Property

All content on helmetcg.com — including text, graphics, logos, design, and code — is the property of Helmet Consulting Group LLC and is protected by applicable intellectual property laws. You may not reproduce, copy, distribute, or use any content from this Site without our written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Helmet Consulting Group LLC, its members, officers, employees, and partners shall not be liable for any:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of revenue, profits, data, or business opportunity
  • Damages arising from your reliance on information on this Site

Our total liability to you for any claim arising from your use of our services shall not exceed the amount, if any, you paid directly to HCG for the specific service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Helmet Consulting Group LLC, its members, officers, and employees from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to:

  • Your use of the Site or our services
  • Your violation of these Terms
  • Any false or fraudulent information you provide
  • Your violation of any applicable law

11. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall first be attempted to be resolved informally by contacting HCG at admin@helmetcg.com. If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association in New York, NY. You waive your right to a jury trial for any such dispute.

Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a new effective date. Continued use of our Site or services after changes constitutes acceptance of the revised Terms.
